THE REGULATION
of the Ministry of Forest and Water Management
of the Slovak socialist Republic
from the 24 November, 1975
on Obligations of the Organisations to submit the Reports
on Discovering Ground Water and to report Data on its Withdrawal
Minister of Forest and Water Management of the Slovak socialist Republic establishes, according to the Article 28 paragraph 2 of the Act No. 138/1973 Coll. on the Water (the Water Act):
Subsection One
Submitting the reports on discovering ground water
Article 1
(1) The organisation, which discovers the source of ground water 1) with the yield, bigger than 1 l per second
a) during the construction of facility for withdrawal of ground water,
b) during the research, exploration or checking the sources and regime of
ground water,
is obliged to submit written report on it to Hydrometeorologic Institute in Bratislava (hereafter the Institute).
(2) The same obligation applies to the organisation, which discovers
a) during investment activity, as it is mentioned in paragraph 1
a), significantly different quantity of ground water,
as it was assumed in exploration or in the project,
b) during seeking and exploration of mineral deposit, the ground water
with assumed total yield 2) bigger than 10 l per second,
c) during any of its activities, the source of ground water with tense
water level (artesian water), and with the yield, bigger than 0,5 l per
second.

1) the Article 2 of the Water Act.
2) Total yield of the water source presents the quantity of the water,
which can be withdrawn from relevant locality (source).
Article 2
(1) The organisation, which discovers the source of ground water, during the activities, listed in the Article 1 paragraph 1 a), and paragraph 2, will submit the report to the Institute, within 30 days, after discovering the source of ground water. In the report, it will be mentioned:
a) its title and place,
b) exact localisation of the appearance of the ground water source
(region, district, town, cadastral area, and plot number of the land)
with clear situation,
c) data on the quantity, type, quality and the statement of the level of
ground water,
d) the date of discovering of the appearance of the ground water
source,
(2) Organisation, which discovers the ground water source during the activities, listed in the Article 1 paragraph 1 b), will send one elaboration of final report to the Institute, within 30 days, after its elaboration.
(3) The Institute is authorised to require from the organisation the explanations, and other necessary data to reported ones, and to use his own employees to verify reported data at the lands and objects of the organisation, as well as to verify the appearance of ground water at all.
Article 3
The organisation, which from the 1st January 1976, expects to conduct the research or exploration of ground water for the aims of its withdrawal, is obliged, before starting the jobs, to find in the Institute the statement of the exploration of ground water in interest areas, and to use so explored data, for these jobs.
Subsection Two
Article 4
Reporting the data on the withdrawal of ground water
(1) The organisation, which uses ground water in the quantity exceeding 1250 m3 per month, or artesian water, is obliged to report its withdrawal to Institute, within 30 days after starting the withdrawal, in the extent, and in the method, mentioned in the Annex to this Regulation.
(2) Organisations, which have the report obligation, according to paragraph 1, are obliged annually to report to the Institute, the data on the withdrawal, by the end of January of following year, at special forms, which they will receive from the Institute, after fulfilling the obligation, according to paragraph 1.
(3) The Institute reports total data on the withdrawal of ground water by the end of February each year, to national committees, relevant for admitting the withdrawal of ground water, and to the administrators of water flows, important from water management point of view. 3)
(4) The organisation is obliged to determine unused yield, and report it to the Institute together with the data on the withdrawal, when realising the withdrawal of ground water from sources, artesian drills, or from artesian wells.
(5) In the cases, which will be determined by national committee, relevant for admitting the withdrawal of ground water, the organisation will obliged to measure the withdrawal of ground water by water meters, respectively by any other meters.
(6) The Institute is authorised to require the explanation and document materials to reported data, from the organisations, and to verify these data by own employees.

3) The administrators of the water flows, important from water management point of view are state water management organisations: Danube waterhed, Váh waterhed, Hron waterhed, and Bodrog and Hornád waterhed.
Subsection Three
Preliminary and final provisions
Article 5
The organisation, which uses ground water, will send the report to the Institute, according to the Article 4 paragraph 1, within two months, after this Regulation enters into force.
Article 6
This Regulation does not apply to mining water, 4) to natural medicinal sources of the water, and to the sources of natural table mineral water. 5)

5) the Art. 31 par. 2 of the Regulation No. 26/1972 Coll. on the Protection
and Development of Natural Medicinal Spas and Natural Medicinal Sources.
Article 7
This Regulation enters into force on the day of its announcement.
