THE REGULATION

of the Ministry of Forest and Water Management

of the Slovak socialist Republic

from the 9th June, 1976

on Water Managers

 

The Ministry of Forest and Water Management of the Slovak socialist Republic establishes, according to the Article 16 paragraph 2 of the Act of the Slovak National Council No. 135/1974 Coll. on State Administration in Water Management, after the agreement with participated state administration bodies:

 

Establishing water managers

 

Article 1

 

(1) Organisations are obliged to establish qualified workers for arranging qualified water managing and treatment the waste water (hereafter „water managers“):

 

a) if they withdraw, or otherwise usesurface or ground water,

respectively, if they use the water from public waterpiping for their

production goals, in total quantity, exceeding 1 250 m3 per month,

or 15 000 m3 annually,

b) if they discharge waste water or extraordinary water, exceeding at its

formation:

1. the pollution, characterised by the ratio BOD 5 in the quantity

bigger than 5 tons per calendar year,

2. insoluble materials in the quantity bigger than 25 tons per calendar

year,

3. petroleum materials, exceeding the concentration 10 mg/l and total

quantity of 5 tons per calendar year,

4. soluble inorganic salts, exceeding the concentration 1 000 mg/l and

total quantity of 50 tons per calendar year,

5. materials with clear acidity or clear alkalinity, exceeding the

concentration 0,5 mval/l and total quantity of 500 KGs equivalent per

calendar year,

6. radioactive materials or infected materials (e.g. water from

infection hospital departments, from sanitary animal killing, from

caffilleries, from injection materials production places, e.t.a.),

7. poisons. 1)

 

(2) If single department or business unit fulfils the conditions, listed in the paragraph 1, then the organisation is obliged to establish water manage even for this department or business unit.

 

(3) The organisations, which withdraw, or otherwise use the water for fish-breeding purposes, do not have the obligation to establish water manager, event though, they otherwise fulfil the conditions, listed in paragraph 1 a).

Article 2

 

Supervised organisations and bodies, as well as their central bodies, are obliged to establish water manager, if any of the organisations, which is managed by them, has the obligation to establish water manager, according to the Article 1.

 

Article 3

 

If it is reasonable, and if it will not disturb fulfilling the tasks, the function of water manager may be combined with any other activity, or the water manager may be established jointly for several departments or business units, respectively, the water manager of the organisation may be ordered this function for individual departments.

 

Article 4

 

The organisations are obliged to report the names and working place of the persons, established for the function of water manager, to water management body, relevant for admitting the handling with water, which establishes the obligation for the organisation to establish the water manager, if this obligation is based on the water withdrawal from public waterpiping, to district national committee, from spatial area of which, the water from public waterpiping is being withdrawn; the report has to be done also for the change, or for new establishing the water manager.

 

Activities of the water managers

 

Article 5

 

Water managers, established according to the Article 1, when arranging qualified managing with water and treatment waste water for the organisation, department or for business unit, for which they have been established, fulfil mainly following tasks:

 

a) monitor keeping the generally binding legal provisions, issued in the

area of water management, as well as fulfilling the decisions from water

management bodies,

b) prepare, propose and evaluate water management measures, related to the

development of the production, respectively to the changes of the

technology,

c) perform regular technical and economical analysis,

d) elaborate the proposals for improving water management and for

improving the quality of discharged waste or extraordinary water,

e) arrange keeping the manipulation guidelines, and arrange its harmony

with current statement of water management of department, business unit,

or organisation,

f) permanently monitor and control the statement and operation of the

facilities, which arrange water management and treatment the waste

water,

g) monitor and control managing with water,

h) propose and monitor realisation of necessary measures, respectively

realise these measures themselves, in case of failure of tretment

facilities, or during operational breakdowns, which result even in

short-term impairment of the quality of water,

i) arrange the things, so that water management decisions, related to the

operation of the department, business unit or the organisation, are

available for water management supervision, as well as for main water

management supervision.

 

Article 6

 

Water managers, established according to the Article 2, during arranging qualified managing with water, and treatment waste water for supervised organisation, body, or for central body, for which they have been established, mainly these tasks:

 

a) elaborate the conception of managing with water and of treatment waste

water,

b) methodologically manage, and from qualified point of view, control the

water managers, subordinated to the organisation,

c) regularly evaluate managing with water and treatment waste water in

subordinated organisations, and perform necessary technical and

economical analysis,

d) elaborate total reports on managing with water,

e) monitor water management interests, during investment activity.

 

Qualification of water managers

 

Article 7

 

(1) Water manager may be the worker, who achieved University or complete secondary professional education in the water management, chemical-technological, or in any other similar area, respectively complete secondary general education, followed by specialised course for water mangers. The degree of required education will be determined by the organisation, adequately to the character of the working position, for which, the water manager is being established. When considering other similar statement, the character of the working position, for which the water manager is being established, and the subjects of the educational background of absolved school, are being taken into consideration.

 

(2) In extraordinary cases, the worker with complete secondary general education may be established for the water manager, if, within three years from the day of his appointment, he will take specialised course for water managers.

 

(3) Water managers are obliged to permanently update their knowledge at the area of handling with water, and its protection.

 

Article 8

 

The workers, who, as for the day of entering this Regulation into force, were taking the position of water manager, according to previously valid provisions, are being considered capable for executing the water manager position, even though, they do not fulfil the requirements as for the education, according to the Article 7.

 

Preliminary and final provisions

 

Article 9

 

(1) The first report, according to the Article 4, are the organisations obliged to realise within 6 months from the day, after this Regulation enters into force; otherwise, always within 15 days, after establishing the water manager.

 

(2) The organisations of agricultural production sphere will establish the water manager, according to the Article 1, gradually, no later than by the 1st January, 1978. This provision does not touch the obligation for supervised organisation and bodies, and their central bodies, to establish water managers, according to the Article 2, as soon as any of the organisations, managed by them, fulfils the assumptions for establishing the water manager, according to the Article 1.

 

Article 10

 

The obligations for the organisations, resulting from this Regulation, in the area of the operancy of the Federal Ministry of National Defense, are being arranged by military bodies, industrial organisations, and industrial organisations according to special statutes.

 

Article 11

 

The Directives of the Ministry of Agriculture, Forest and Water Management No. 58 880/73-1961 and of the Ministry of Health No. HE-3240/19.11.1961 for the operation of department, business unit, division and resort water managers (registered in the Part 31/1966 Coll.) are being abrogated.

 

Article 12

 

This Regulation enters into force on the 1st July, 1976.
