on Spatial Planning Supporting Materials and Spatial Planning Documentation

The Federal Ministry for Technical and Investment Development enacts under Article 143 par. 1 a), b), c) Act No. 50/1976 Coll. on Spatial planning and on Building Order (of the Building Act):

 

PART ONE

INTRODUCTORY PROVISION

 

Article 1

 

Basic Concepts

 

A large spatial unit is an area on which more settlement units are located or a large area on which special interests are applied (protection of formation of landscape, extraction, industry, agriculture, recreation etc.).

A settlement unit is each unit of settlement, which forms a closed, from other units of settlement spatially separated unit.

A zone is a spatially connected part of a settlement unit or landscape whole that is characterised by a specific determining feature as a rule by a function or position alternately it can be an area of a small settlement unit.

An interest area is an area adjacent to the settlement unit, in which the present or perspective relations towards the settlement unit prevail and in which the lay-out must be solved in mutual functional and technical dependence on the settlement unit.

A registration letter of spatial planning documentation is a list of selected data from prepared spatial and planing documentation; it serves for creation and updating of registers of integrated information system on the area.

A purveyor is an institution that procures spatial planning supporting materials or spatial planning documentation.

An expert is a legal entity of a natural person that prepares spatial planning documentation and spatial planning supporting materials on basis of an authorisation. 1)

PART TWO

SPATIAL PLANNING SUPPORTING MATERIALS

(Re Articles 3 to 7 of the Act)

 

Article 2

A town planning study is being procured by a building office or by that institution of spatial planning that needs it for regulating of use of area. A town planning study can be procured and to its elaboration can be contributed by everybody that will take part in using of area.

Contents and range of town planning study is specified in its assignment, which is put together or as the case may be approved by the institution of spatial planning or by the building office.

A town planning study will be used mainly as a tool for spatial town planning creative activities, for verification of basic conception of solution for spatial plan and for assessment of bearing capacity of load of the area. It is elaborated also for partial and specific problems of the area, for acquisition of alternative solutions.

As long as it is necessary to deliberate the town planning study from the point of view of its use, especially if is supposed to be a supporting material for spatial proceedings or for elaboration of spatial planning documentation then the way of its deliberation will be specified by the competent building office or by an institution of spatial planning. In deliberation of the town planning study the appropriate procedure is used under Articles 25 and 26 of this Regulation.

Article 3

Master Plan

Master plan is procured by the building office or by that institution of spatial planning that needs it as a supporting material for working out of spatial planning documentation or for extending it.

The institution that procures a master plan specifies its contents and scope in accordance with Article 5 of the Act. On basis of assignment the master plan will be worked out by an expert.

The master plan does not replace branch general plans that are being procured by competent branch institutions or organisations and which are used in elaborating of spatial planning documentation.

Spatial and Technical Supporting Materials

Article 8

The system of spatial and technical supporting materials consists of :

spatial and technical supporting materials for elaborating of spatial planning documentation, for spatial decision taking and for permitting of structures;

spatial planning supporting materials of integrated information system on area, which serves for automated processing of data about the state and conditions of area about intentions of its arrangement and about proposed, in progress and implemented changes in using of the area

spatial and technical supporting materials mainly for conception of development of settlement, care for the environment and for determination of spatial systems of ecological stability, for appraising of plots and sets of selected data for rehabilitation of towns and communities,"

 

Central institutions of state administration for spatial planning, after an agreement with other central institutions of state administration, ensure a unified way of spatial identification and structure of data on the area, enabling processing them into the shape of spatial and technical supporting materials and at the same time they specify a unified methodology of elaboration and using the supporting materials under paragraph 1 they process and update long term conceptions of spatial development of the republics.

Article 9

Procuring of Spatial and Technical Supporting Materials

Procuring of spatial and technical supporting materials consists of :

preparatory work

elaboration of spatial and technical supporting materials

Article 10

Preparatory Work

The purveyor is responsible for execution of preparatory work; it ensures, from professional legal entities or natural persons performing business activities under special regulations, elaboration of data on the area within the necessary scope, form and assembly drawings for the given set of spatial planning supporting materials according to unified methodology.

Article 11

Elaboration of Spatial and Technical Supporting Materials

The work on spatial and technical supporting materials consist of

complementing and processing of data on the area, which cannot be obtained from legal entities or natural persons doing business under special regulations authorised by accumulating, preserving, processing and providing them

elaborating of documentation of spatial and technical supporting materials.

The purveyor follows the course of elaboration of spatial and technical supporting materials, mainly abiding by the methodology and procedures of work.

Article 12

Elaboration of Documentation of Spatial and Technical Supporting Materials

The documentation of spatial and technical supporting materials must in an understandable and clear form provide basic and complex information on the state, possibilities and tendencies of development of respective area and its individual parts.

Article 13

Verification and Issuing of Spatial and Technical Supporting Materials

The completeness of elaborated set of spatial and technical supporting materials is verified by the purveyor, who after verification of completeness will specify the way of their use and application according to the purpose, for which they have been elaborated.

Article 14

Amendments and Additions to the Spatial and Technical Supporting Materials

The purveyor shall ensure amendment or addition of spatial and technical supporting materials or their parts in cases of important changes in the area or after completing on new statistical fact finding.

Article 15

Filing of Spatial and Technical Supporting Materials

The purveyor will specify the way of filing of sets of spatial and technical data in institutions of spatial planning.

The institutions of spatial planning, in which the spatial and technical supporting materials are filed, will provide them to the institutions of state administration and communities and then next as the case may be to all entities, which take part in use of the area.

PART THREE

SPATIAL PLANNING DOCUMENTATION

(Re Articles 8 to Article 38 of the Act)

Article 16

The basic category for all stages of spatial planning documentation is a spatial plan :

for a large spatial unit it is elaborated with concentration mainly on the perspective structure of settlement, regional spatial systems of ecological stability, transport and technical amenities

for a settlement unit it is elaborated with concentration mainly on the town planning conception and use of land (for example as plan of use of areas)

for zones it is elaborated as regulation (development) plan with concentration mainly on regulation elements of utilisation of plots.

A spatial plan for small settlement units can be elaborated also with concentration on elements solved differently in a spatial plan for a zone and a spatial plan for large zones can, if necessary, contain solution elaborated differently in spatial plans of settlement units.

In case it is necessary a spatial prognosis is elaborated as a rule for the degree of a large spatial unit.

In case it is necessary a spatial project is elaborated as a rule for the degree of a zone.

The approved spatial planning documentation is a supporting material for expropriation for structures beneficial to the public and can also serve as a supporting material for awarding of state benefits.

Procuring of spatial planning documentation includes :

preparatory work

assignment of research and analyses

elaboration and deliberation of prognosis task, spatial and economic principles, development program

assignment of spatial planning documentation and supervision of its elaboration

deliberation of spatial planning documentation

Article 17

Preparatory work is performed by the purveyor, they are ensured in co-operation with other institutions of state administration, institutions of communities and legal entities and natural persons that participate in using of the area.

The purveyor shall accumulate the necessary supporting materials on the condition of the area and on intentions of its development, they will evaluate them and specify the objective of solution and a degree of spatial planning documentation and delimit the scope of the solved area, at the same time it will particularly provide to the expert supporting materials that are supposed to be used for processing of research and analyses and which are binding for the solution of spatial planning documentation.

Article 18

Assigning of Research and Analyses

The purveyor will assess the acquired supporting materials and will work out a standpoint to their utilisation and will delimit the solved area; on basis of this work they will assign to the expert research and analyses necessary for working out of a necessary degree of spatial planning documentation according to the size of the area that is being solved.

Article 19

Elaborating of Research and Analyses

The research and analyses are worked out by an expert. Their target is to ascertain and to evaluate the present state, discrepancies and development tendencies of the area as supporting material for elaboration of a prognostic task, spatial and economy principles, programmes of development and for elaborating of the proposal of spatial planning documentation.

The expert is obligated to use all so far elaborated supporting materials, particularly spatial and technical supporting materials and accessible research and analyses; for repeating or adding to some of the already performed research reasons must be given. New research will be executed by the expert only within range that is necessary for solution of the given tasks and it will be handed over into the set of spatial and technical supporting materials.

Research and analyses comprise as a rule text, charts and graphic part inclusive summary drawing of the issue showing main clashes of interests in the area.

Article 20

Prognostic Task, Spatial and Economy Principles, Development Program

For putting together of prognostic tasks, spatial and economy principles and programs of development the basis are the supporting materials under Article 17 par. 3 and the results of research and analyses executed by an expert.

The proposals of prognosis task, spatial and economy principles and programmes of development will be elaborated by a purveyor in co-operation with the affected institutions of state administration and communities, the areas of which have been affected by the solution. The proposals of these documents are submitted for suggestions to the public, the suggestions must be applied within the set deadline, not later than within 30 days from the day of their publication.

The spatial and economy principles and development program after having deliberated it with the public (for spatial plans and projects of zones also with the affected legal entities and natural persons that have ownership or other rights towards the land or structures) will be approved by that institution that will be approving the spatial planning documentation.

The prognosis task, spatial and economy principles as well as program of development will specify the contents and scope of spatial planning documentation, procedure of work and complex requirements for solution of the area. Basic contents of spatial and economy principles are entered in annex No. 1.

Elaborating of Spatial Planning Documentation

Article 21

The spatial planning documentation will be worked out by an expert.

Elaboration of spatial planning documentation comprises :

preparatory work

necessary additions to research and analyses

elaborating of concept of solution

elaborating of proposal of spatial planning documentation

 

Purveyor follows the progress of spatial planning work, controls work and discusses discrepancies.

Expert of spatial and panning documentation keeps records of important negotiations and decisions affecting the solution and files documents on them.

Basic contents of selected spatial planning documentation are entered in annex No. 2.

All parts of spatial planning documentation, spatial and technical supporting materials, research and analyses are principally worked out on unified supporting maps.

Article 22

On basis of prognostic task or spatial and economy principles of program of development the expert will work out a scheme in which s/he will specify the contents, scope and procedure of work and a manner of solution of the task.

The scheme, with which also purveyor agreed is a supporting document for making of a contract on elaborating of spatial planning documentation.

Article 23

In well founded reasons the expert can perform additional research and analyses necessary for elaborating of the assigned category of spatial planning documentation; the scope and reasons for this will be entered in the scheme of the task.

Article 24

An expert will work out a draft for solution of spatial planning documentation in accordance with conclusions from research and analyses and on basis of the prognostic task or spatial and economy principles or a development program, which specify the contents as well as scope of draft of solution of spatial planning documentation. S/he shall pay attention to keeping general technical conditions for development. 4) The draft of solution is concentrated on complex town planning solution of the area within identical scope as the proposal. As a rule it is elaborated in alternatives or variants and it is a supporting material for deliberation and decision about further concentration and completing of the task.

The elaborating of draft of solution of spatial planning documentation can be dropped in case, if before assignment the solution was tested by the deliberated town planning study under Article 2 paragraph 4, which will replace the draft of solution according to paragraph 1.

4) Regulation No. 83/1976 Coll. on General Technical Conditions

 

 

Article 25

Deliberation of the draft of solution is public, it is managed and organised by the purveyor. It is connected to all deliberations of the expert with the affected institutions of state administration, institutions of communities and natural persons and legal entities, alternatively to the public inquiry.

The deliberation of the draft of solution will be concentrated on verification of the correctness of basic conception of solution, complexity of the proposed solution particularly with respect to load-bearing capacity of the area, to proposed systems of transport and technical infrastructure with the objective to recommend the selected alternative or variant to the approving institution.

A superior institution of spatial planning that executes methodological and professional supervision will participate in deliberation of the draft of the solution.

Article 26

The draft of the solution will be deliberated with the institutions of the communities, the areas of which are affected by the solution, with the affected institutions of state administration and with the public under paragraph 2, for spatial plans and projects of zones also with the affected natural persons and legal entities that have ownership or other rights towards land or structures.

The purveyor will invite the affected institutions of state administration from communities, natural persons and legal entities not late than 30 days before the deliberation and will ensure that within this deadline they could acquaint themselves with the draft of solution. The institutions, natural persons and legal entities will notify their standpoint not later than within 15 days from the day of deliberating of the draft of the solution. Attention is not paid to the standpoints applied after this deadline.

Deliberations under paragraph 2 are declared in public using the way common in the place. The purveyor will always ensure for deliberation of the draft of solution its understandable professional explanation and written records of applied standpoints.

Article 27

According to the results of deliberations the purveyor shall elaborate, not later than within three months after he had received a draft of solution, a summary standpoint containing instructions for completing of work and conditions of adjustment and additions to the proposed solution or in case it is necessary s/he will order new deliberations of the draft of the solution. If on basis of results of deliberations of the draft of the solution a change in spatial and economy principles or program of construction occurs, the summary standpoint, inclusive the change in spatial and economy principles or in a program of construction, must be submitted for approval to the institution that has approved the original spatial and economy principles or the program of construction.

In case of use of town planning study under Article 24 par.2 the summary standpoint will replace the approved assignment of spatial planning documentation.

Article 28

The proposal of spatial planning documentation will be checked by the purveyor after ending of suggestions proceedings :

The checks will be focused mainly on :

 

completeness of documentation

complexity of the proposed solution, feasibility and intensity of use of areas and facilities; abiding by regulations approved by spatial planning documentation of higher degree

verification, whether all conditions and requirements applied in deliberations of the draft of the solution, included into the summary standpoint of the institution of spatial planning were applied in the proposal

verification whether all technical requirements for construction have been fulfilled

contents of the proposal of principles of control of town planning conception of development of the area for spatial prognoses, regulations for arrangement of area for spatial plans and conditions of implementation for spatial projects

quality of elaboration of documentation

 

If the purveyor finds out deficiencies in spatial planning documentation they will enforce on the expert their removal.

 

Article 29

According to results of checking of proposal of spatial planning documentation the purveyor will work out a proposal of resolution of approval, which contains

scope of validity and obligation of spatial planning documentation and tasks resulting from the solution

for spatial plans regulations for arrangement of area and for spatial projects conditions of implementation

If one of the parts of the spatial prognosis is being approved then the proposal under paragraph 1 contains principles of control of town planning conception of the development of the area.

To the proposal of resolution a report stating the reasons will be connected containing mainly a brief characteristics of the proposed solution and data how the suggestions and objections to the proposal of spatial planning documentation have been settled.

The purveyor will agree upon the proposal of resolution with other institutions of the appropriate national committee, with the affected institutions of state administration and with the national committees, the spatial area of which is directly affected by the solution of spatial planning documentation.

 

According to the result of checking of the proposal of spatial planning documentation the purveyor shall work out a proposal of resolution on approval that shall contain

scope of validity and obligation of spatial planning documentation and tasks resulting from solution, inclusive delimitation of the structures beneficial to the public

regulations of land use and its spatial arrangement, which contain binding principles for lay-out of area and limits for utilisation of the area

results of deliberation of spatial planning documentation

 

If one of the parts of the spatial prognosis is being approved then the proposal under paragraph 1 contains principles of control of town planning conception of the development of the area.

To the proposal of resolution a report with stated reasons will be attached containing particularly a brief characteristics of the proposed solution and data on how the suggestions and objections to the proposal of spatial planning documentation have been settled.

The purveyor will prepare a proposal of resolution in co-operation with the affected institutions of state administration and institutions of communities, the areas of which have been affected by the solution of spatial planning documentation.

Article 30

In case of spatial plans, after ending of suggestions proceedings the superior institution of spatial planning will work out a standpoint to the proposal of their solution. For elaborating of the solution a proposal of spatial plan will be used then assessment from deliberations of the proposal, the result from suggestions proceedings concerning the proposal of resolution of approval and the result from checking of the spatial plan by a purveyor. The standpoint is an annex to the proposal of resolution on approval of the spatial plan.

The standpoint to the proposal of the spatial plan contains mainly :

evaluation of harmony of the proposal of the spatial plan with spatial and economy principles;

evaluation of the conception of solution and its harmony with the approved spatial planning documentation of the higher degree

evaluation of the conception of solution and its harmony with the conception of spatial development of the republics

consideration of the completeness of the contents, protocol of approval and binding parts of the spatial plan;

recommendation under which conditions the proposal of the spatial plan can be approved

A similar procedure is used in the case of a spatial project, as long as it is being deliberated as a spatial plan, 5) and for spatial prognosis, 6) if one of the parts of its solution is being approved as a guiding binding supporting material for control of further development of the area.

Article 31

 

In case of the approved spatial plan and spatial project the purveyor will provide the main drawings, the accompanying report and regulations with the insertion of approval, which shall particularly contain the following

 

denomination of the approving institution

serial number and date of approval

stamp and signature with the name, surname and function of the authorised person

 

Effectuality of Spatial planning Documentation

 

Article 32

 

The spatial prognoses are of orientation character; however some parts may be approved as guiding alternately as binding.

From the solution of spatial prognosis as binding can be solved unequivocal elements of the structure of settlement of the solved settlement, principles of transport, technical infrastructures and spatial systems of ecological stability.

Article 33

Spatial plans contain binding and guiding parts, which will be delimited by an approving institution.

From the solution of a spatial plan as binding will be approved those regulations the specify mainly :

in case of a large spatial unit

conception of the structure of settlement, principles for utilisation of the area and limits of its utilisation, delimitation of regional spatial systems of ecological stability, conception of transport and technical facilities, inclusive delimitation of corridors or as the case may be areas for structures beneficial to the public

in case of a settlement unit

town planning conception of spatial arrangement with specification of utilisation of area, principles of arrangement of transport and civic amenities and technical fixtures and local spatial systems of ecological stability, delimitation of area for structures beneficial to the public

in case of a zone

utilisation of parcels and objects, elements of system of ecological stability, regulating elements of spatial lay-out (for example street and construction lines, heights and volumes of development, indicators of utilisation of the area, solution of transport and technical facilities) and delimitation of areas for the structures beneficial to the public.

 

Article 34

Spatial projects are binding in the part, which solves the concrete positioning of structures and utilisation of area, as binding are approved especially conditions for implementation of structures inclusive control elements of spatial lay-out and specification of areas for structures beneficial to the public.

 

Article 35

 

Changes and Supplements to the Spatial Planning Documentation

 

Supplements and changes are done in the binding part of spatial planning documentation, adjustments in its guiding and orientation part.

Impulse for elaborating of a supplement or change of the spatial planning documentation is given by the purveyor; elaboration is permitted by that institution that has approved the spatial planning documentation.

Adjustments of spatial planning documentation are carried out by its purveyor.

In the approved spatial planning documentation the supplements, changes and adjustments are not drawn, only a record about them will be performed into the main drawing. Supplements, changes and adjustments are processed graphically as independent transparency or independent drawing and the text will be an independent attachment of the approved spatial planning documentation.

Article 36

Filing of Spatial Planning Documentation

A complete elaboration of spatial planning documentation of a large spatial unit is filed in the central institution of state administration for spatial planning of the republic and in all district offices the area of which is affected by the solution. According to the agreement it also can be filed in the Municipality Office of the capital Praha, Municipality of the Capital of the Slovak Republic Bratislava and alternatively in offices of other towns.

A complete elaboration of spatial planning documentation of the settlement unit and zone is filed in the office of the community for which it has been procured, alternately at the institution that has procured the spatial planning documentation and in the building office as long as it is a different institution than the institutions mentioned.

The central institution of state administration for spatial planning of the republic keeps records on the approved spatial planning documentation in the area of the republic. For these records the purveyor is obligated to send them the copies of resolutions on approving of the spatial planning documentation and registration letters of spatial planning documentation with selected data on approved spatial planning documentation for integrated information system on the area.

The Ministry of Construction and Technology of the republic keeps records on approved spatial planning documentation, which has been worked out in the area of the respective republic. For these records the purveyor is obligated to send to the ministry of construction and technology of the republic the copies of resolutions on approving of spatial planning documentation and registration letters certified by the approving institution.

The spatial planning documentation the validity of which has been cancelled will be handed over to the respective archives for permanent filing and putting into archives. 7)

Article 37

 

Number of Copies of Spatial Planning Documentation

 

The purveyor shall order a proposal of spatial planning documentation in so many copies so that it can be filed in all institutions entered in Article 36 par. 2

The draft of spatial planning documentation will be ordered by the purveyor in the number copies corresponding to the need of operative deliberations however not in less than two copies.

 

PART FOUR

CONCLUDING PROVISIONS

 

Article 38

 

Abrogating Provision

 

From the day of coming this Regulation into force it is not possible to proceed under the following measures issued for execution of the Act No. 84/1958 Coll. on spatial planning:

 

methodological instructions of the Federal Ministry for Technical and Investment Development dated 2nd November 1971 for Elaborating of Proposals of Change of Functional Utilisation of Land (Part 7/1971 News Bulletin of the Federal Ministry for Technical and Investment Development. Ministries of Construction and Technology of the Czech Socialist Republic and of the Slovak Socialist Republic)

instructions No. 4 of the Federal Ministry for Technical and Investment Development dated 10th July 1972 for deliberation of proposals of spatial plans from the point of view of investment demands of the complex apartments development (Part 4/1972 News Bulletin of the Federal Ministry for Technical and Investment Development and Ministries of Construction and Technology of the Czech Socialist Republic and of the Slovak Socialist Republic).

Article 39

Efficiency

This Regulation comes into force on 1st October 1976, Regulation No. 377/1992 Coll. comes into force on 17th July 1992.

The spatial planning documentation in progress on the day of coming this Regulation into force, if it is does not enable its application for the required functions in the area, will be adjusted according to it.

 

ANNEX

 

ANNEX NO. 1

Basic Contents of Spatial and Economy Principles

Spatial and economy principles for solution of all stages of spatial plans contain particularly :

reasons for procuring of a spatial plan and determination of output targets of the development, expressing development program of the purveyor and variants of trends of the overall development of the area, which are supposed to be solved

preliminary delimitation of the solved area

relations to higher spatial unit than the solved area

basic demographic data

requirements on protection and creation of the environment and on spatial systems of ecological stability

requirements from the point of view of protection of soil, deposits of minerals, cultural monuments, in the interest of civilian defence and routes of superior systems of transport and technical facilities etc.

principles of application of the results of spatial prognosis in case it was elaborated

specific requirements and conditions for overall solution and for adjustment and scope of documentation of the draft and proposal

 

For a large spatial area :

 

evaluation of size of important settlement units and their function in the structure of settlement

demographic outlooks

evaluation of limits of utilisation of land

 

For a settlement unit :

binding parts of previous spatial planning documentation and spatial planning documentation of higher degree as long as a need of their changes and supplements does not result from deliberations of spatial and economy principles

size of the settlement unit and its assumed development

importance and functions of the settlement unit in the structure of settlement

specific requirements and conditions for solution of reconstruction of the settlement unit and utilisation of areas

basic characteristics of the development of transport and conception of technical equipment inclusive disposal of waste

specific requirement and conditions for town planning conception of a settlement unit

requirements for partial spatial -technical solutions of individual zones and their areas inclusive delimitation of areas for structures beneficial to the public

requirements and conditions for solution of mutual relations of settlement unit and its area with respect to load-bearing capacity of the area.

Number and contents of main and supplementing drawings, models, schemes, panoramas etc. will be specified individually by a purveyor according to the nature and scope of solved tasks. All regulations that can be shown graphically must be marked.

A Proposal of Regulations of Spatial Development

containing precisely formulated principles of spatial arrangement and utilisation of the area, which are a supporting material for working out of a document of approval.

Spatial Plan of a Settlement Unit

 

Textual Part of the Proposal of the Solution :

basic development preconditions of the settlement unit

delimitation of the solved area on basis of individual cadastres

proposal of organisation and utilisation of the area divided into polyfunctional area and monofunctional areas with description of feasibility and permissibility of individual activities

determination of limiting or excluding conditions for utilisation of individual areas and intensity of their utilisation, specification of control of utilisation of individual areas, shown in generally understandable legend (prohibitions, permissible manners and coefficients of utilisation)

claims on areas outside the built-up area of settlement unit

claims on structures beneficial to the public

 

Graphic part with main drawings, the supporting materials of which are maps of scales 1 : 10 000, 1 : 5 000, or as the case may be 1 : 25 000 (for small settlement units in scale of the land map), with complete town planning proposal delimiting the development of the settlement unit with delimitation of individual areas.

proposal for solution of transportation relations and transport with delimitation of protective bands and marking of harmful impact of transport on the environment

proposal of solution of technical facilities of settlement units containing mainly proposal water management, power and telecommunication facilities

informative delimitation of stages of construction especially for structures beneficial to the public

solution of the interest area and broader relations documenting inclusion of the solved settlement unit into the system of settlement

evaluation of requirements for seizure of agricultural and forest soil

proposal of local spatial system of ecological stability

In case of small settlement units, with the consent of purveyor independent drawings will be worked out only when it is not possible to show the required solutions and evaluation in the main drawings.

The spatial plan for a zone :

Textual part of the proposal of the solution with these requirements that extend the contents of textual part entered in the spatial plan of the settlement unit :

specific characteristics of the zone resulting from its position and functions

connection of the solved zone to the broader area

control elements for spatial and architectonic solution (for example street and building lines, heights, volumes and shapes of development, indicators of utilisation of parcels, overground and underground floors)

solution of transport and technical facilities

 

Graphic part with main drawings the supporting material of which are land maps of recording of properties in the scale 1 : 2000, 1 : 1000, with complex proposal containing basic composition principles of organisation of the area with marked areas, way of development, control elements, reserve special area, elements of ecological stability.

Independently is being processed the proposal of solution of transportation relations, transport with marking of protective zones of transport, in case it is necessary with marking of entrances and drive-ways into plots, proposal of solution of technical facilities of the area and evaluation of requirements for seizure of agricultural and forest soil.

 

Independent Insertion of Civilian Defence

In carrying out of research and analyses of elaboration of a spatial plan and spatial project of a zone in co-operation with competent institution of civilian defence the purveyor ensures gradual additional elaboration of spatial planning documentation by an independent insertion, which solves hiding of population and those objects are specified in it, which can be used for double purpose for the needs of civilian defence.

Statement of the approving institution on approving of the spatial plan

Statement of the approving institution on declaration of the approved spatial plan by a generally binding legal regulation, which is entered in the annex of the proposal of resolution and contains mainly these parts :

Introductory part, in which spatial and temporal scope of validity of the spatial plan has been specified

Basic principles of arrangement of the area and limits of its utilisation; this part specifies the binding regulations of functional and spatial arrangement of the area of the solved spatial plan.

Structures beneficial to the public and rehabilitation measures, for which it is possible to expropriate or to limit ownership rights towards plots and structures.

Conclusive provisions, in which it will be stated where the spatial plan has been filed and data of effectiveness.

Statement of approving institution on objections applied in deliberations of the spatial plan explicit statement, in which way it has been decided about objections of legal entities and natural persons that have ownership or other rights towards affected land solved by a spatial plan of a zone and on objections concerning structures beneficial to the public and rehabilitation measures,

Statement of the approving institution expressing opinion to the standpoint of superior institution of spatial planning.
