THE REGULATION
of the Ministry of Forest and Water Management
of the Slovak socialist Republic
from the 30th of August, 1976
on Slovak Water Management Inspection
The Ministry of Forest and Water Management of the Slovak socialist Republic established, according to the Article 12 paragraph 1 of the Act of the Slovak National Council number 135/1974 Coll. on State Administration in Water Management:
Article 1
Basic provisions
(1) The Slovak Water Management Inspection (hereafter the Inspection) is being established, as a professional control body of the Ministry of Forest and Water Management of the Slovak socialist Republic (hereafter the Ministry), in the matters of the protection of the quality of water, and managing with the water.
(2) Main inspector, who is being appointed and recalled by the Minister of Forest and Water Management of the Slovak socialist Republic (hereafter the Minister), manages the Inspection, and is also responsible for its activities.
(3) The statute, which will be issued by the Minister, will specify the details on the organisation of the Inspection.
Tasks of the Inspection in the frame
of main water management supervision
Article 2
The Inspection realises supervision on:
a) discharge of waste or extraordinary water into surface or ground
water,
b) construction, operation and maintenance of the treatment plants of waste
water, and other facilities, serving the aim of reducing or eliminating
the pollution of water, being discharged into surface or ground
water,
c) protection of surface and ground water against its polluting by
other materials, than waste water,
d) protection of natural accumulation of the water and water sources
against polluting,
e) general using of surface water, and using the water for shipping, and
for wood floating, so that such usage does not endanger the purity of
water,
f) fulfilling the basic obligations, when handling the water, if they do
apply to protection of the water against pollution, and on effective
and nation-industrial reasonable using of water, and on fulfilling the
conditions of the approvals from water management bodies, related to the
protection of the water,
g) effective and reasonable handling with water also in the relation to
creating and using the norms of the need and usage of water, if it is
not general using of surface water or its using for shipping and for
wood floating, respectively using as a mining water and for elevation
of the water,
h) fulfilling the obligations by water management organisations, and by
those, who handle water, respectively administer water management
works, mainly if it is:
1. monitoring the quantity and quality of surface, ground,
extraordinary and waste water,
2. monitoring other materials, than waste water, including
radioactivity,
3. preparation of preventive measures for the protection of water
against pollution,
i) fulfilling the provisions on the compensations in the water management,
if they relate to the protection of the water against pollution and
effective and reasonable handling with water.
Article 3
If the Inspection discovers the insufficiencies in the activities of controlled organisations, then it will impose necessary measures for elimination of these, respectively imposing the fines, to water management body. If the inspection thinks, that the decision of water management body was issued disputable to the Act, or to any other generally binding legal provision, then it will provide the action for its exploration, outside appeal proceedings.
Article 4
The co-operation and assistance of the Inspection
with national committees
(1) The Inspection, during fulfilling its tasks according to this Regulation, co-operates with national committees, mainly if it is the realisation of water management supervision of national committees at the organisations, and co-activity with other bodies and organisations, in the field of the protection of the quality of water; in such matters, the Inspection provides the proposals and initiatives for use, to national committees, during the realisation of their water management supervision.
(2) The Inspection provides professional assistance to national committees, mainly for commenting the investment activities, for preparation of the changes in the production process or in the extent of the production of the organisations, and for the change and modification of water management works, which is significant from the point of view of protection of water purity; it provides them with professional assistance also with preventive actions, mainly with elaborating, realising and evaluating the measures, related to avoiding the polluting of water and ineffective handling them.
Article 5
Another tasks of the Inspection
(1) For fulfilling the tasks of the Ministry in the field of the protection of water purity, the Inspection:
a) prepares basis for annual and five-year plans of the construction of
waste water screenings, and for another measures for the protection of
the water against pollution, including monitoring the preparation and
construction of waste water screenings, and for another measures for
reducing the pollution and for statistical evaluation of this
construction,
b) prepares basis for the comments from the Ministry, for centrally
considered buildings, influencing the quality of water,
c) processes the basis for negotiations of trustees of the Government of
the Czechoslovak socialist Republic on border flows from the point of
view of protection water purity, and arranges fulfilling of accepted
measures,
d) keeps the overview of fines, imposed according to the Decree of the
Government of the Slovak socialist Republic No. 31/1975 Coll. on Fines
for Infringing the Obligations, established in the area of water
management,
e) evaluates and keeps the records on emergency impairments of the water
quality,
f) arranges fulfilling the tasks, determined by the Ministry, resulting
from negotiation of the Council of Head Water Management Bodies of
member countries of the Council for Mutual Economic Assistance,
g) processes the analysis in the area of the protection of water sources,
and based on the results of supervision, it proposes the measures for
long-term development of improving the purity of water,
h) elaborates and arranges fulfilling of measures, resulting from the
statements of state bodies in the area of the protection of water purity
against pollution, including the protection of ground water of
Zitný ostrov and of other preserved areas of natural accumulation of
water, arranges the co-ordination of fulfilling of accepted measures by
involved resorts,
o) monitors distribution of investment limits at relevant central bodies,
and capacity covering of waste water buildings,
j) methodologically directs the divisions of water management chemistry, at
the organisations for flow administration,
k) participates at setting the technical norms in the matters of the
protection of water quality, and in the matters of managing with water,
and checks fulfilling the technical norms in the sphere of its operancy.
(2) The Inspection also fulfils the tasks, resulting from special provisions. 1)

Article 6
Authorisations of representatives of the Inspection
The provision of the Article 13 of the Act of the Slovak National Council No. 135/1974 Coll. on State Administration in Water Management, applies to the authorisations of representatives of the Inspection, which relates to execution of main water management supervision and to supervision, according to special provisions.
Article 7
The co-operation with other bodies and organisations
(1) The Inspection, during fulfilling its tasks, co-operates mainly with central bodies ant its organisations and the bodies of Peoples control, with bodies of hygienic service, with bodies of memorial care and nature protection, and with social organisations.
(2) During fulfilling its tasks, the Inspection co-operates also with the organisations, which handle water, and are obliged to establish water managers, and provides the professional assistance to them.
Article 8
This Regulation enters into force on the day of its announcement.
