ORDER OF THE GOVERNMENT

of the Slovak socialist Republic

from the 19th April, 1978

on Preserved Area of Natural Accumulation of the Water on Zitný ostrov

 

Amendment: 52/1981 Coll.

 

The Government of the Slovak socialist Republic orders, according to the Article 18 of the Act No. 138/1973 on the Water (the Water Act):

 

Article 1

 

The area of Zitný ostrov, which by its natural conditions create important natural accumulation of ground and surface water, is being announced for preserved area of natural accumulation of the water (hereafter „preserved water management area“).

 

Article 2

 

(1) This Order relates to preserved water management area; the provision of the Article 4 relates also to the area of the capital town of the Slovak socialist Republic, Bratislava. 1)

 

(2) Preserved water management area is situated at the area bordered by the river Danube, on its part between the capital town of the Slovak socialist Republic Bratislava and village Palkovicovo, by the channel Palkovicovo - Aszód, up to his junction with Malý Dunaj, further by Malý Dunaj up to the opening of Suchý Potok, by Suchý Potok, by Cierna Voda, further by connecting channel near the village Nová Dedinka and again by Malý Dunaj up to his deviation from Danube in Bratislava, including the channels of mentioned water flows, besides the main channel of Danube. 2)

 

(3) The area of preserved water management area will be marked in the evidence of the immovable properties, kept by relevant bodies of geodesy and cartography.

(1 : 50 000) is up to the Ministry of Forest and Water Management of the

Slovak socialist Republic.

 

Article 3

 

(1) In the preserved water management area, it is necessary to create favourable conditions for the formation and saving of the sources of ground and surface water, and arrange general protection of these water.

 

(2) In the preserved water management area, it is possible to plan and perform industrial, technical or other similar activity, only in the accordance with the message and needs of this area. The harmony of industrial interests with the requirements for the protection of ground and surface water, is being arranged mainly in the frame of nationindustrial plans and spatial planning documentation.

 

(3) In the preserved water management area, it is prohibited

 

a) to build or to extend

1. industrial objects, in which the materials, endangering the quality

or health harmless quality of the water (hereafter „harmful

materials“) 3), are being used or produced,

2. other objects, which produce waste water, containing poisons or

radioactive materials, 4)

3. oilducts and produceducts, which are being used for transport of

harmful materials, 5)

4. warehouses of oil materials with total capacity over 200 m3 and with

the capacity of individual containers over 50 m3,

5. warehouses of other harmful materials, 6) of which capacity exceeds

the need of own operation of the object (facility, establishment);

 

b) to establish the landfills of industrial waste, containing harmful

materials. 7)

 

(4) The water management bodies, when issuing the admittance, approvals and comments 8) for the buildings, facilities, respectively for the activities, which may unfavourably influence the water relations in the preserved water management area, are obliged to depart from the need of the protection of the water of whole preserved water management area; in these cases, they act in the tight co-operation with the Slovak Water Management Inspection. 9)

 

(5) The buildings, facilities, respectively activities, according to the par. 4, are mainly:

 

a) animal production farms with big capacities 10) and agrochemical

centres,

b) using liquid waste from animal production farms of big capacity for

moisturising,

c) the landfills of solid town waste.

 

(6) In the agriculture and in the forest industry, it is possible, in preserved water management area, to use pesticides or other preparations for the protection of the plants and for the obliteration of the pests and useless plants only in the extent, which will be determined by the Ministry of Forest and Water Management of the Slovak socialist Republic, after the agreement with the Ministry of Agriculture and Nourishment of the Slovak socialist Republic and the Ministry of Health of the Slovak socialist Republic.

 

(7) Investment activity in national factory Slovnaft Bratislava, is being managed according to special rules, which will be determined by the Ministry of Economy of the Slovak socialist Republic, after the agreement with the Ministry of Forest and Water Management of the Slovak socialist Republic.

The Ordinance of the Ministries of Health and Justice No. 57/1967 Coll.,

through which, the Governmental Order on Poisons and other materials,

harmful to health, is being executed.

The Ordinance of the Ministry of Health of the Slovak socialist Republic

No. 65/1972 Coll. on the Protection of the Health against ionising

radiation.

5) the Art. 1 par. 1 a) to c), e) to j) of the Ordinance No.

23/1977 Coll.

6) the Art. 1 par. 1 b) to f), h) and j) of the Ordinance No.

23/1977 Coll.

7) the Art. 1 par. 1 a) to c), e) to h), i) points 2, 3 4 and

j) of the Ordinance No. 23/1977 Coll.

8) the Art. 8 to 14 of the Water Act.

9) the Art. 4 of the Ordinance of the Ministry of Forest and Water

Management of the Slovak socialist Republic No. 117/1976 Coll. on the

Slovak Water Management Inspection.

10) Animal production farms with big capacities are the farms with total

capacity, for breeding cows over 400 pieces, for breeding the calf over

800 pieces, for breeding young beef cattle over 500 pieces, and for the

stall objects for feed breeding over 500 pieces of beef cattle; for

breeding the pigs over 5000 pieces, for sow birth places and breeding

places for pigs in pre-feed over 700 pieces.

 

Article 4

 

(1) In the preserved water management area, and in the area of capital town of the Slovak socialist Republic Bratislava, it is necessary to handle used petroleum oils, which without the regeneration, can not be used for original purpose (hereafter „used oils“), in the way, so that they can not endanger the quality or health harmless quality of the water in the preserved water management area.

 

(2) Socialist organisations, which are the users of petroleum oils, follow special provisions 11), when handling used oils.

 

(3) Other users of petroleum oils are obliged, in the preserved water management area and in the area of capital town of the Slovak socialist Republic Bratislava, to capture and to concentrate used oils, without separating specific types, in impenetrable storing containers or in the wrappings, at their own costs, and make sure, that these will not be further depreciated and polluted. These users are obliged to take used oils to national factory Benzinol Bratislava, unless they can securely and effectively use these used oils, at their own costs, so that they do not endanger the quality or the health harmless quality of the water, in the preserved water management area.

11) The principles for collecting, repurchase, regeneration and other using

of used petroleum oils, approved by the Statement of the Government of

the Slovak socialist Republic, from the 15th April, 1981, No. 116.

 

Article 5

 

The Ministry of Forest and Water Management of the Slovak socialist Republic and other relevant water management bodies check on fulfilling the provisions of this Order, permanently control, whether the provisions on the protection of ground and surface water in the preserved water management area are being followed, whether the decisions issued by them are being followed, and in the extent of their operancy, they impose the actions for removing discovered insufficiencies. 13)

Article 6

 

The interests of the protection of the state and of the protection of state border, as well as the interests, protected by special provisions 14), are not being touched by this Order.

Article 7

 

This Order enters into force on the 1st July, 1978, the Order of the Government of the Slovak socialist Republic No. 52/1981 Coll. enters into force on the 1st June, 1981.
