ORDER of the Ministry of Environment of the Slovak Republic

from 16^th of December, 1996,

which amends the Order on the Conditions for Providing and Using the Funds

from the State Environmental Fund of the Slovak Republic

The Ministry of Environment of the Slovak Republic, according to the article 5 par. 7 of the Act of the Slovak National Council, No. 128/1991 Coll. on State Environmental Fund of the Slovak Republic establishes:

Article I

The Order of the Slovak Environmental Commission No. 176/1992 Coll. on the Conditions for Providing and Using the Funds from the State Environmental fund of the Slovak Republic, is being amended as follows:

1. In the article 5, par. 2 reads:

„(2) Expected costs of the construction, in other cases total expected costs, needed for realising the action, are being considered for the total costs, referred to in this Order.".

2. In the article 7 par. 2 subpar. a), the following words are being excluded: „architect, supplier, author of solution,".

3. In the article 7, par. 2 adds the subparagraph g), which reads:

„g) the method of selecting the supplier ²⁾.".

Remark to the reference 2) reads:

„2) the article 2 par. 2 subpar. d) of the Act of the Slovak National Council No. 263/1993 Coll. on Public Arrangement of Goods, Services and Public Jobs (the Act on Public Arrangement), in wording of the Act of the Slovak National Council No. 120/1996 Coll.".

4. In the article 7, par. 3 reads:

„(3) Applicant for providing the funds for investment activity, will add to his application

selected parts of project documentation, that is the budget, summary technical report, and situation drawing,

the building licence, ³⁾

the decision and the opinions, regarding the impacts to environment, which condition the approval of the construction, ⁴⁾

the agreement on associating the funds, if it was concluded.".

 

The remarks to the references 3) and 4) reads:

„3) the article 54 of the Act No. 50/1976 Coll. on Spatial Planning and Building Order (the Building Act).

4) E.g. the articles 8 and 13 of the Act No. 138/1973 Coll. on Water (the Water Act), the article 4 of the

Act No. 238/1991 Coll. on Waste, in wording of the Act of the Slovak National Council No. 255/1993

Coll., the article 27 par. 1 of the Act of the Slovak National Council No. 272/1994 Coll. on the

Protection of People’s Health.".

Article II

This Order enters into effectiveness on January 1^st, 1997.
